Acceptance of terms
By accessing or using KindHeadsUp, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform. These terms apply to all users of the service.
What KindHeadsUp is
KindHeadsUp is a platform that allows users to send anonymous, pre-approved, respectful notifications to individuals via SMS and phone call. All messages are pre-written and reviewed by us. Users cannot customize the message content.
Acceptable use
You may only use KindHeadsUp to send genuine, well-intentioned notifications to people you believe would benefit from receiving them. You must not use the platform to harass, intimidate, threaten, or harm any individual. You must not send notifications to the same recipient repeatedly in a way that constitutes harassment. You must provide accurate recipient information.
Prohibited uses
You may not use KindHeadsUp for any unlawful purpose, to send notifications to minors, to impersonate any person or entity, to attempt to identify or expose the sender of any notification, to reverse-engineer or scrape the platform, or to use the service in any way that could damage, disable, or impair it.
Payments and refunds
All payments are processed securely by Stripe. Charges are non-refundable once a notification has been successfully delivered. If delivery fails due to a technical error on our end, we will issue a full refund. Refund requests must be submitted within 7 days of the transaction.
No guarantee of delivery
While we make every effort to deliver notifications promptly, we cannot guarantee delivery in all cases. Delivery may be affected by factors outside our control, including carrier restrictions, invalid phone numbers, or network issues. We are not liable for failed deliveries caused by inaccurate recipient information provided by the user.
Intellectual property
All content, design, and technology on KindHeadsUp is owned by or licensed to us. You may not reproduce, distribute, or create derivative works from any part of the platform without our written permission.
Disclaimer of warranties
KindHeadsUp is provided 'as is' without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, KindHeadsUp and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability for any claim shall not exceed the amount you paid for the specific transaction giving rise to the claim.
Changes to these terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the platform after changes constitutes acceptance.
